Abstract

Plea bargaining is a process in which a defendant in a criminal case agrees to plead guilty in exchange for some
concession from the prosecutor or the court. Plea bargaining is challenges the necessary basis of crime and
punishment that is the foundation of the criminal law and the criminal justice system. This paper refers to a person
charged with a criminal offence (accused) negotiating with the prosecution for a lesser punishment than what is
provided in law by pleading guilty to a less serious offence. Plea bargaining is a concept in which an agreement takes
place between the State and the accused by which he pleads guilty in exchange. The system of plea bargaining is in
its experimental stage.
